DL SOSTEGNI TER, LEGGE N° 25 DEL 28 MARZO 2022.
Through an amendment to the Decree Support Ter, converted into law, the possibility arrives in Italy – for the first time in our country – we welcome non-European citizens who carry highly qualified activities, through the use of technological tools in smart working. Hurray! Italy, once again, in terms of work and hospitality, scores and climbs the ranking. Italy, from a cultural, historical and landscape point of view, represents a destination, indeed a Zibaldone of destinations, ideal for the aspiring remote workers and digital nomad.
It happens that, the Minister of Labor, the Minister of Foreign Affairs and the Ministry of Tourism will have to work in concert, through an Inter-ministerial Decree, for what requires the approval of this amendment, and that is to define its requirements.

New non-EU remote workers who decide to carry out their profession remotely or in smart working in Italy, will be welcomed, through a residence permit for special work reasons, without the limitations of migration flows (see our article of 27 January 2022, Blog, HR section, www.kairoslbc.com). Here is that a foreign company and not resident on our national territory, can have its own work resources abroad, so even here in Italy.
Among the requirements to have the residence permit of digital nomad, there is the verification of the minimum wage, a declaration of the company for which you are working or proof of being self-employed. The qualification must comply with parameters of professionalism to be considered. In addition, you must be in possession of health or accident insurance, valid throughout the entire Italian territory. If all salary and tax commitments are respected, the holder will be issued a first residence permit, as a digital nomad for one year, without the need for any other type of authorization.
Who are these remote workers or digital nomads??
They are women and men, citizens of non-EU countries, who perform highly professional and digital tasks independently and are characterized by the fact that the provision of activities does not take place at the company's operational headquarters but in smart working and remotely.
Rumours anticipate that, for most of these remote workers, the residence permit for work can be extended up to a maximum of two years, and may eventually include the whole family.
Pending the Inter-ministerial Decree, these voices are the corollary to a future political scenario on the structural reform of smart-working. In fact, on a parliamentary initiative, the bill for Law C2908 presented on 24 February 2021 is being examined in the Chamber.
I would like to make a necessary clarification. The entry into force of the Law will take place after the 15 days of vacatio legis, that is, 15 days after the date of publication on March 28, 2022. The Ministry of the Interior will have 30 days from the entry into force of the Law to indicate the provisions of Article 6d, last paragraph.
STOP! Do not permit to fears the rising of bad thoughts!
No more invasion will come! On the contrary! These people, if they will be a significant number, will turn into insurance policies on our life, including work. Finally a driving force for the national and territorial economy! In fact, in addition to working and therefore receiving a salary from their companies, they will live in Italy, learn customs and traditions, perhaps the language, and spend their extra EU money, right here, in Italy! And their employers, even the big CEOs of mega corporations, will work to ensure that peace and prosperity reign in Italy. I truly hope that digital nomads will become millions and billions, a great flow of colourful humanity.
The more we are, the stronger we become, only if united!
